On October 20, 2010 a panel of the Inquiry Committee requested Mahmood Savji, CLR#1894 (“the Registrant”) consent to undertakings in three files which were brought before it:
File 1: The Registrant agrees to comply with the Health Professions Act, Opticians Regulation, College Bylaws and the Professional Standards of Practice; undertakes not to repeat the conduct which is the subject matter of the complaint and comply with the Opticians Regulation including the Schedule - Limits and Conditions on the Conduct of Independent Automated Refractions, and the Professional Standards of Practice specifically section 8 (c), (d) and (e) on Accepted Practices for the use of Auto refractors/Automated Systems; and successfully complete the College of Opticians of British Columbia’s Sight Testing Jurisprudence Course within 60 days of this undertaking being signed. The Inquiry Committee is satisfied that the undertaking will protect the public.
File 2: The Registrant agrees to comply with the Health Professions Act, Opticians Regulation, College Bylaws and the Professional Standards of Practice; undertakes not to repeat the conduct which is the subject matter of the complaint and comply with the Opticians Regulation including the Schedule - Limits and Conditions on the Conduct of Independent Automated Refractions and the Professional Standards of Practice, specifically section 8 (d) and (e) on Accepted Practices for the use of Auto refractors/Automated Systems; contact Pacific Blue Cross and remove the authorization number (reserve) from the complainants account within 7 days of this undertaking being signed; and will successfully complete the College of Opticians of British Columbia’s Sight Testing Jurisprudence Course within 60 days of this undertaking being signed. The Inquiry Committee is satisfied that the undertaking will protect the public.
File 3: The Registrant agrees to comply with the Health Professions Act, Opticians Regulation, College Bylaws and the Professional Standards of Practice; immediately cease and desist from conducting auto-refraction on people over the age of 65 without a signed referral from a prescriber; undertakes not to repeat the conduct which is the subject matter of the complaint and comply with the Opticians Regulation including the Schedule - Limits and Conditions on the Conduct of Independent Automated Refractions, specifically section 5 (a) and comply with the Professional Standards, section 8 on Accepted Practices for the use of Auto refractors/Automated Systems; and successfully complete the College of Opticians of British Columbia’s Sight Testing Jurisprudence Course within 60 days of this undertaking being signed. File 1: The Registrant agrees to comply with the Health Professions Act, Opticians Regulation, College Bylaws and the Professional Standards of Practice; immediately cease and desist from conducting auto-refraction on people over the age of 65 without a signed referral from a prescriber; undertakes not to repeat the conduct which is the subject matter of the complaint; comply with the Opticians Regulation including the Schedule - Limits and Conditions on the Conduct of Independent Automated Refractions, specifically section 5 (a) and (c), 6 (c) and comply with the Professional Standards, section 8 on Accepted Practices for the use of Auto refractors/Automated Systems; he will successfully complete the College of Opticians of British Columbia’s Sight Testing Jurisprudence Course within 60 days of this undertaking being signed; and consents to a reprimand. On March 17, 2009 a panel of the Inquiry Committee requested Lee Thompson, CLR#1289 (“the Registrant”) to consent to undertakings in which the Registrant agreed to comply with the Health Professions Act, Opticians Regulation, College Bylaws and the Professional Standards of Practice; immediately cease and desist from using any auto-refraction on people under the age of 19 without a signed referral from a prescriber and undertakes not to repeat the conduct which is the subject matter of the complaint and comply with the Professional Standards of Practice, section 8 on Accepted Practices for the use of Auto refractors/Automated Systems. The Inquiry Committee is satisfied that the undertaking will protect the public.
